Senior Historian Steve Swisdak Published in Environmental Law in New York

History Associates senior historian and litigation research deputy director Steve Swisdak authored the cover article for the May 2009 issue of Environmental Law in New York

The article, “Researching Past Uses of New York Industrial Sites,” builds upon Mr. Swisdak’s nearly six years of expertise overseeing complex historical research projects on several New York industrial sites. In the article, Mr. Swisdak offers a historian’s perspective on the proper methodology to employ in defending against Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) claims, conducting All Appropriate Inquiries (AAIs) for Brownfield redevelopments, or identifying potentially responsible parties (PRPs) for natural resources damages (NRD) cost allocations. Mr. Swisdak examines the legal obligations and opportunities for historical site research in New York, the importance of developing a sound, yet flexible, historical research plan, and some of the key federal, state, and local historical records sources for information on the past uses of New York industrial sites.
